stiu ca nu-ti dai cu presupusul, dar decizia de azi (pt L3) nu inseamna ca de acum inainte CNAIR poate sa semneze linistita contracte doar pe baza deciziei CNSC?
Fara posibiltiatea de anulare a contractului (ci eventual sa se judece doar pentru despagubiri)?

CNAIR putea semna in baza hotararii primei instante (CNSC sau TB) si pana astazi. Exista o prevedere legala in acest sens in legea achizitiilor publice, deci nu este nimic nou.

Acum daca tot m-am apucat sa scriu, sa spunem ca mai exista o chestie despre care nu v-am spus, dar o sa dezvolt subiectul in functie de evolutia situatiei.

Stiu ca puteau semna, dar acum au si confirmarea din partea CAB. Stiu ca la noi nu se pune precedentul, dar nici nu poti ignora complet o asemenea decizie.

La ce "confirmare din partea CAB" te referi? Astazi CAB a decis doar in privinta revizuirii recursului pentru T3, dar asta este un fel de etapa 1,5 de contestatii (etapa 1 fiind contestatia la CNSC si apoi recursul la CAB, iar 0,5 am pus revizuirea recursului), care in mod normal nu exista.

crezi ca CNAIR va semna de acum inainte contracte doar cu decizia CNSC?
Inteleg ca "puteau si inainte", eu vreau sa stiu doar daca tu crezi ca vor si incepe sa o si faca. Adica daca vom mai avea asemenea situatii in perioada imediat urmatoare. Sau cazul loturilor 3 si 4 a fost doar exceptia care confirma regula

E greu sa prezici ce va face CNAIR. :lol:
Presupun totusi ca va mai calca pe bec si va mai incerca atribuiri dupa decizia primei instante (CNSC sau TB), iar uneori becul se va sparge, si alteori nu. :lol:

World Bank Group Debars China Railway Construction Corporation Ltd. and two subsidiaries

WASHINGTON, June 5, 2019 — The World Bank today announced the nine-month debarment of China Railway Construction Corporation Ltd. (CRCC), a Chinese, state-owned construction and engineering company, and its wholly-owned subsidiaries, China Railway 23rd Bureau Group Co., Ltd. (CR23) and China Railway Construction Corporation (International) Limited (CRCC International), in connection with misconduct under the East-West Highway Corridor Improvement Project in Georgia. 

The debarment is part of a settlement agreement with CRCC, CR23, and CRCC International related to misconduct during the procurement process for a highway construction contract. The debarment also extends to CRCC's 730 controlled affiliates, with the exception of China Railway 20th Bureau Group Co. and its controlled affiliates, which were subject to a separate settlement agreement with the World Bank in 2017.

Some of the goals of the affected project were to reduce road user costs along a highway corridor section in Georgia and to strengthen the capacity of the roads department to manage the road network. According to the facts of the settlement, during the prequalification and bidding process for a highway construction contract, the three named companies prepared and submitted information that misrepresented the personnel and equipment of CR23 and the experience of other entities in its group as CRCC's. Within the World Bank's administrative Sanctions System, these actions are considered fraudulent practices as defined by World Bank Procurement Guidelines.

Following their nine-month debarment, CRCC, CR23, CRCC International, and their 730 controlled affiliates will be conditionally non-debarred for 24 months.  During this period, they will again be eligible to participate in World Bank-financed projects as long as they comply with their obligations under the settlement agreement. If they do not, the conditional non-debarment will convert to debarment with conditional release.

The settlement provides for a reduced period of debarment in light of CRCC, CR23, and CRCC International's acknowledgement of responsibility, their voluntary remedial and corrective actions, their cooperation with INT, and other mitigating factors.  As a condition for release from sanction, the companies and their affiliates commit to enhancing their integrity compliance programs in a manner consistent with the principles set out in the World Bank Group Integrity Compliance Guidelines.  The company also commits to continue to fully cooperate with the World Bank Group Integrity Vice Presidency.

In cazul licitatiei pentru T4, ofertantul este CHINA RAILWAY 14TH BUREAU GROUP CO LTD. O fi si asta o firma detinuta de statul chinez, dar nu apare nici o mentiune expresa despre ea in comunicat, ci doar daca eventual se incadreaza in gramada celor 730 de firme.

Cititi mai atenti liniile alea unde zice de 730 de companii. Le-a fost interzisa participarea la achizitii publice desfasurate de Banca Mondiala pentru 9 luni, urmata de 24 de luni in care accesul era / este conditionat.

Si la noi ce s-a intamplat in cazul CHINA RAILWAYS 14TH? Au considerat suspendare 3 ani de la data producerii evenimentului, ca asa zice legea, si atunci se incadreaza in perioada asta si momentul depunerii ofertelor, iar in DUAE ar fi informatii false, respectiv nementionate, plus ca ar fi vorba de o "abatere profesionala grava" raportat la acea achizitie publica din Georgia.

Pe de alta parte, voi credeti ca chinezii au participat cu toate cele 730 de companii la achizitia aia publica? Daca una sau mai multe din cele 730 de companii nu a participat, ce facem?

CNAIR a spus singura ca CHINA RAILWAY 14TH BUREAU GROUP CO LTD este o societate separata fata de cele sanctionate de Banca Mondiala, si ca nu au participat la procedura de achizitie publica din Georgia.

Va fi distractiv de acum incolo sa contesti si sa evoci vreo astfel de "abatere profesionala grava" prin cine stie ce tara gen Congo si apoi sa elimini de la licitatiile de la noi mari firme internationale. :lol:

cu risc de off topic si minusuri, eu as paria ca UMB  a depasit nivelul normalitatii, mai ales daca ne raportam la situatia economica din RO. Ceea ce ma ingrijoreaza cel mai mult e cat de sanatoasa/sustenabila e cresterea pe termen lung al acestei asocieri de firme. si ma gandesc la  mentalitatea conducerii actuale fata de ce o sa vina din urma.
